Determination of questions of membership of Senate and Assembly
46. 1. Any question whether -
a. any person has been validly appointed as a Senator; or
b. any person has vacated his seat as a Senator or is required under the
provisions of paragraph (a) of section 39(3) to cease to perform his functions
as a Senator,
shall be determined by the High Court, whose decision shall be final.
2. Any question whether -
a. any person has been validly elected as a member of the House of assembly;
or
b. any person has vacated his seat as such a member or is required under the
provisions of paragraph (a) of section 45(2) to cease to perform his functions
as such a member,
shall be determined by such authority or authorities as may be prescribed by
any law in force in Barbados.
